§ 1 Basic Provisions
1. Scope of Application: These General Terms and Conditions (GTC) apply to all contracts concluded via the website of INSTNCT GmbH, Heliosstraße 6a, 50825 Köln.
2. Consumer/Entrepreneur: A consumer in the sense of these GTC is any natural person who enters into a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a legal partnership acting in the exercise of their commercial or independent professional activity when concluding a legal transaction.
§ 2 Conclusion of Contract
1. Ordering Process: The customer can select products from the range of INSTNCT GmbH and collect them in a so-called shopping cart by clicking the "Add to Cart" button.
2. Contract Conclusion: The contract is concluded when the customer completes the ordering process by clicking the "Order with obligation to pay" button. By placing the order, the customer submits a binding offer.
§ 3 Contract Content and Prices
1. Products: INSTNCT GmbH offers clothing and accessories.
2. Prices: All prices are inclusive of the statutory value-added tax and exclusive of shipping costs.
§ 4 Payment Terms
1. Payment Methods: INSTNCT GmbH accepts the following payment methods:
▪ Credit and Debit Cards: Visa, Mastercard, American Express, Maestro, UnionPay.
▪ Mobile Payments: Apple Pay, Google Pay, Shop Pay.
▪ Local Payment Methods: Sofortüberweisung, Klarna (Pay Later, Pay Now), Bancontact, iDEAL, EPS.
▪ Payment Service Providers: PayPal, Amazon Pay.
2. Payment Conditions: Payment is due immediately upon conclusion of the contract.
§ 5 Shipping Conditions
1. Delivery Times: Delivery times are 4-10 business days within the EU and 4-12 business days outside the EU.
2. Shipping Costs: Shipping costs will be displayed during the ordering process.
§ 6 Right of Return
1. Return Period: The customer has the right to return the goods within 14 days of receipt.
2. Return Costs: The customer bears the costs for the return shipment.
3. Exchange: No items are excluded from exchange.
§ 7 Disclaimer of Liability
1. Limitation of Liability: INSTNCT GmbH is liable for damages only in cases of intent or gross negligence.
2. Product Description: The product descriptions are carefully prepared. However, INSTNCT GmbH assumes no liability for minor deviations.
